The new U.S. Census Bureau regulation requiring mandatory automated filing of export information
As of July 2, 2008, the U.S. Census Bureau will require mandatory filing of export information through the Automated Export System (AES) or through AESDirect for all shipments where a Shipper's Export Declaration (SED) has been required. Census published the final rule in the Federal Register on June 2, 2008, amending Title 15, Code of Federal Regulations, Part 30 Foreign Trade Regulations (FTR) in its entirety.
1. Paper SED will no longer be accepted
Electronic Export Information (EEI) will be required to be filed electronically through either the AES or AESDirect. AESDirect is an internet -based application offered free of charge by Census for companies that register on-line at the following website
www.aesdirect.gov
There is a ninety day implementation period from July 2, 2008
2. 15 CFR 30.4 calls for the EEI to be filed in AES or AESDirect according to specifiic timeframes
Vessel cargo, 24 hrs prior to loading in the port of lading
3. U.S. Customs and Border Protection (CBP) has been delegated authority to enforce new penalty provisions for violations of the FTR as follows:
- failure to file EEI in AES
- late filing of EEI in AES
- other FTR violations, such as incorrect value, failure to cite license code, etc.
